Accommodation Terms

Makkari TAKIBI Camp Accommodation Terms

The accommodation terms and conditions of Makkari TAKIBI Camp (hereinafter "the Facility") are set forth as follows.

Article 1

Scope of Application

The accommodation contract and related contracts between the Facility and guests shall be governed by these terms. Where the Facility has established separate individual rules or regulations, they shall apply in conjunction with these terms. Matters not stipulated in these terms or individual rules and regulations shall be governed by applicable laws or generally established customs. 2. If the Facility agrees to special terms that do not violate laws or customs, such special terms shall take precedence over the provisions of the preceding paragraph.
Article 2

Application for Accommodation

1. When applying for an accommodation contract, the applicant shall provide the following information: (1) Name of the applicant (2) Name of the representative guest (3) Number of guests (4) Date(s) of stay, number of nights, and estimated arrival time (5) Other information deemed necessary by the Facility 2. If a guest requests to extend their stay beyond the number of nights specified in item (4) above during their stay, the Facility shall process such request as a new accommodation contract application at the time the request is made, subject to availability.
Article 3

Formation of Accommodation Contract

1. The accommodation contract is formed when the Facility accepts the application and the applicant completes payment of the deposit as stipulated in Article 4 (Payment of Charges). However, this shall not apply when it is proven that the Facility did not accept the formation of the contract. 2. The deposit shall first be applied to the final accommodation charges payable by the applicant or guest, and in the event of circumstances requiring application of Articles 6 and 15, shall be applied to penalty charges followed by compensation, with any remaining balance refunded pursuant to Article 14.
Article 4

Payment of Charges

1. Accommodation charges may include room charges, meal charges, and optional service charges in addition to the room rate. 2. Detailed accommodation charges can be confirmed on the Facility's reservation page or partner travel agency (including Online Travel Agent) reservation pages. 3. Payment of accommodation charges shall be made by cash, credit card, electronic money, bank transfer, or other methods designated by the Facility to the applicant or guest. 4. Accommodation charges shall be collected even if the guest voluntarily does not stay after the room has been made available.
Article 5

Refusal of Accommodation Contract and Accommodation

1. The Facility may refuse to enter into an accommodation contract or refuse accommodation in the following cases: (1) When the application does not conform to these terms. (2) When rooms are fully occupied. (3) When the prospective guest is deemed likely to engage in conduct that violates laws, public order, or good morals. (4) When the prospective guest falls under any of the following items (a) through (d): (a) When the person is under 20 years of age and not accompanied by a parent or legal guardian. (b) When the person accompanying a minor cannot be confirmed as a parent or legal guardian. (c) When the Facility deems confirmation of accompaniment necessary, and the accompanying person refuses to present identification and provide a copy thereof. (d) When the person refuses to present identification for age verification at check-in. (5) When the prospective guest is deemed to fall under any of the following items (a) through (c): (a) An organized crime group (as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members), organized crime group members (as defined in Article 2, Paragraph 6 of the same Act), associate members, or other antisocial forces. (b) A corporation or other organization whose business activities are controlled by an organized crime group or its members. (c) A corporation having among its officers any person who is an organized crime group member. (6) When the prospective guest has engaged in conduct that significantly disturbs other guests. (7) When the prospective guest is clearly identified as having a communicable disease. (8) When violent demands are made or unreasonable burdens are requested regarding accommodation. (9) When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable reasons. (10) When applicable under prefectural ordinances of the Facility's location.
Article 6

Cancellation of Accommodation Contract

1. Guests may cancel the accommodation contract by notifying the Facility. 2. When a guest cancels the accommodation contract due to reasons attributable to the guest, penalty charges shall be collected based on the cancellation policy established at the time of reservation.
Article 7

Right of Cancellation by the Facility and Eviction During Stay

1. The Facility may cancel the accommodation contract or request the guest to leave even during their stay in the following cases: (1) When a guest is deemed likely to violate laws, public order, or good morals, or has done so. (2) When a guest is deemed to fall under any of the following items (a) through (c): (a) An organized crime group, organized crime group members, associate members, or other antisocial forces. (b) A corporation or other organization whose business activities are controlled by an organized crime group or its members. (c) A corporation having among its officers any person who is an organized crime group member. (3) When a guest has engaged in conduct that significantly disturbs other guests. (4) When a guest is clearly identified as having a communicable disease. (5) When violent demands are made or unreasonable burdens are requested regarding accommodation. (6) When accommodation cannot be provided due to natural disasters, facility failures, or other unavoidable reasons. (7) When applicable under prefectural ordinances of the Facility's location. (8) When the guest does not comply with prohibited matters in the Facility's rules (limited to those necessary for fire prevention), including smoking indoors and tampering with fire prevention equipment. (9) When it is discovered that the guest falls under the reasons specified in Article 5, Paragraph 1, Item (4). (10) When the guest has made false declarations regarding registration matters under Article 8, or refuses to register without justifiable reason. (11) When the guest engages in verbal abuse, intimidating behavior, unreasonable demands, sexual harassment, or other harassment toward the Facility's employees. 2. Even when the Facility cancels the accommodation contract pursuant to the preceding paragraph, the guest shall not be exempt from paying for accommodation services. However, if the contract is cancelled due to reasons in item (6), accommodation charges shall be waived and any deposit or accommodation charges already paid shall be refunded.
Article 8

Guest Registration

Guests shall register the following information at the Facility on the day of stay: 1. Guest's name, address, and phone number. 2. For foreign nationals, copies of passports or residence cards of all guests. 3. Presentation of identification for age verification may be requested. 4. When guests under 20 years of age are present, or when the Facility deems confirmation of accompaniment necessary, the accompanying parent or legal guardian may be required to present identification and provide a copy thereof. 5. Other information deemed necessary by the Facility. 6. If false declarations are made regarding the registration items above, or if registration is refused without justifiable reason, accommodation may be denied.
Article 9

Facility Rules

Guests shall comply with the facility rules posted within the premises: 1. Guests may use their room from check-in time (2:00 PM) until check-out time (10:00 AM). For consecutive stays, rooms may be used all day except on arrival and departure days. 2. A key replacement fee of ¥12,000 will be charged if a key is lost. 3. Please refrain from behavior that disturbs other guests (loud voices, noise, etc.). 4. Outdoor socializing and playing music through speakers is not allowed after 8:30 PM. Please keep quiet. 5. Outdoor socializing and playing music through speakers is not allowed before 6:00 AM. Playing near the field and campsite areas is also not allowed. Please keep quiet. 6. Entry and exit from the premises is prohibited after 8:30 PM, except for emergencies such as illness. 7. Entry is restricted to registered guests only. However, this does not apply to non-guests entering for events approved by the Facility. 8. Use of fire (including cooking) inside rooms is prohibited. 9. Smoking and use of mosquito coils inside rooms is prohibited. 10. Bringing and using high-power electrical devices (hair dryers, electric heaters, etc.) is prohibited. 11. During their stay, guests shall properly handle furniture and equipment on the BBQ deck and protect them from rain and snow. 12. Only fire equipment provided by the Facility may be used on the deck. Moving fire pits is prohibited. 13. Do not leave food or drink remains outdoors. 14. During their stay, guests shall properly handle equipment and rental items in the Center House, Yotei Observation Terrace, and other shared facilities to avoid damage. 15. The Center House is for rental item pickup and cooking preparation only. Eating and drinking inside is prohibited. 16. Eating and drinking in shared facilities is prohibited, except during events or with the Facility's permission. 17. Repair costs may be charged for damage to equipment or facilities inside rooms or on the premises.
Article 10

Facility's Liability

1. The Facility shall compensate for damages caused to guests in the performance of accommodation contracts and related contracts. However, this shall not apply when the damage is not attributable to the Facility.
Article 11

Handling of Deposited Items

1. The Facility does not accept valuables for safekeeping. 2. The Facility shall not be liable for loss or damage of items brought into the facility by guests, except in cases of intentional or negligent acts by the Facility.
Article 12

Storage of Guest Luggage and Personal Items

1. When guest luggage arrives at the Facility prior to the guest's stay, the Facility shall responsibly store it and arrange delivery to the room before check-in or hand it over at check-in, provided that the Facility agreed to receive it beforehand. However, luggage handover after check-in time will be arranged on a subsequent day. 2. When luggage or personal items are left behind after check-out, if no instructions are received from the owner or the owner cannot be identified, items shall be stored for 7 days from the date of discovery, then disposed of.
Article 13

Parking Liability

When guests use the Facility's parking area, the Facility merely provides the space regardless of whether keys are deposited, and does not assume responsibility for vehicle management.
Article 14

Guest's Liability

1. When the Facility suffers damage due to intentional or negligent acts by a guest (including violations of the facility rules in Article 9), the guest shall compensate the Facility for such damage. 2. The damages referred to in the preceding paragraph shall include the following costs: (1) Repair or replacement costs for rooms, BBQ decks, shared facilities, and on-site equipment and furnishings. (2) Costs associated with repair, replacement, or loss of rental items. (3) Special cleaning costs due to indoor smoking, vomiting, soiling, etc. (4) Costs of restoring the premises to their original condition resulting from violations of facility rules. (5) Business losses (including lost profits) for periods during which rooms or facilities become unusable due to damage. 3. If a guest causes injury or other damage to other guests, the Facility's employees, or visitors to the Facility, the guest shall resolve the matter at their own responsibility and shall not cause any damage to the Facility. 4. If the Facility receives claims from third parties in relation to the preceding paragraph, the guest shall bear all costs (including attorney fees). 5. If a guest refuses to comply with a request to leave pursuant to Article 7, all damages arising therefrom (including compensation to other guests) shall be borne by that guest.
Article 15

Disclaimer for Internet Services

1. The Facility provides Wi-Fi internet connection service for the convenience of guests, but does not guarantee connection speed, stability, or quality. 2. Guests shall not use the Facility's internet service for illegal activities, acts contrary to public order and morals, acts that infringe on the rights of third parties, or any other improper purposes. 3. The Facility shall not be liable for any damages arising from the use of the Facility's internet service. 4. If a guest's use of the internet causes damage to a third party, the guest shall resolve the matter at their own responsibility and shall not cause any damage to the Facility.
Article 16

Governing Law and Jurisdiction

1. Disputes relating to these terms and accommodation contracts shall be governed by Japanese law. 2. Litigation relating to these terms and accommodation contracts shall be subject to the exclusive jurisdiction of the summary court or district court having jurisdiction over the location of the Facility as the court of first instance.
